Lots2Go – Partner Terms & Conditions
1. Introduction & Relationship
These Auction House Partner Terms & Conditions (“Terms”) apply to all services provided by Lots2Go (“we”, “us”, “our”) to auction houses (“you”, “your”).
By instructing Lots2Go to collect, pack, or ship item(s), or by offering Lots2Go as a postage or delivery option to your buyers, you agree to be bound by these Terms.
You agree to make buyers aware that Lots2Go operates under its own Customer Terms & Conditions and that use of Lots2Go’s services by a buyer is conditional upon acceptance of those Customer Terms & Conditions. This includes, where applicable, displaying or referencing Lots2Go’s Customer Terms & Conditions within your catalogue, bidding platform, invoices, or post-sale communications.
Lots2Go acts as an independent third-party logistics provider. Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between Lots2Go and the auction house.
Auction houses do not act as agents of Lots2Go and are not authorised to make representations, warranties, or assurances on our behalf beyond the scope of these Terms.
2. Scope of Services
Lots2Go provides a collection, packing, and shipping service in support of item(s) sold by the auction house to its buyers.
The Services are provided:

To the auction house, by reducing the operational burden associated with packing, postage administration, and buyer shipping enquiries, and by offering buyers a professional third-party delivery option which can increase bidder confidence and participation; and

To the buyer, by arranging the collection, packing, and delivery of purchased item(s).
The Services may include:

Collection of sold item(s) from the auction house’s premises or another agreed location;
-
Professional packing suitable for courier transit;
-
Short-term operational storage where required;
-
Arrangement of delivery to buyers via third-party courier services;
-
Optional transit insurance where selected.
Lots2Go acts solely as an independent third-party logistics provider. Nothing in these Terms alters the auction house’s role as seller.
Lots2Go does not:
-
Value, authenticate, test, or guarantee the condition of any item(s);
-
Act as an agent of the auction house when dealing with buyers;
-
Provide buyer dispute resolution relating to the sale, descriptions, or condition of item(s).
The auction house remains solely responsible for:
-
Cataloguing, describing, and selling item(s);
-
Collecting buyer payments and premiums;
-
Managing buyer disputes relating to sale, authenticity, or condition.
3. Auction House Responsibilities
The auction house agrees to:
-
Ensure all item(s) are fully paid for by the buyer before authorising collection;

Notify Lots2Go when item(s) are released and ready for collection;
-
Provide reasonable access for collection;
-
Accurately identify item(s) being collected;
-
Make buyers aware that Lots2Go’s services are subject to Lots2Go’s Customer Terms & Conditions.
The auction house remains responsible for:

The accuracy of catalogues, descriptions, photographs, and condition reports;
-
Any representations made to buyers regarding item condition, provenance, or authenticity;
-
Resolving buyer disputes related to the sale.
The auction house must not:
-
Provide pricing, insurance advice, or service guarantees on behalf of Lots2Go;
-
Make representations about delivery times, liability, or insurance beyond the Customer Terms.
Failure to meet these responsibilities may result in delays, additional charges, or refusal of service.
4. Buyer Opt-In & Authority
Where Lots2Go is offered as a delivery option, the auction house confirms that:

The buyer has positively opted in to using Lots2Go;
-
The buyer has been made aware of Lots2Go’s Customer Terms & Conditions;
-
The buyer’s use of the service constitutes acceptance of those Terms.
The auction house is authorised by the buyer to confirm instructions and release item(s) to Lots2Go.
Lots2Go may rely on instructions provided by the auction house as confirmation of buyer authority and shall not be responsible for disputes resulting from incorrect or incomplete instructions.
5. Collections & Access
Collections are arranged once item(s) are confirmed as paid and released.
The auction house agrees to:

Provide access during agreed times;
-
Segregate item(s) from unsold or withheld lots;
-
Ensure item(s) are clearly labelled with at minimum the correct lot number and with any additional information reasonably requested by Lots2Go;
-
Ensure item(s) are safely accessible and ready for removal.
Lots2Go is not responsible for:
-
Delays caused by access issues or unavailable staff;
-
Item(s) that are not segregated or incorrectly labelled;
-
Failed collections caused by incorrect or incomplete information.
Lots2Go may charge reasonable failed collection or re-visit fees.
Risk remains with the auction house until physical collection by Lots2Go, at which point risk transfers under the Customer Terms.
6. Payments & Charges
Payment may be collected:
-
Directly from the buyer by Lots2Go; or
-
By the auction house on Lots2Go’s behalf, where agreed.
Where the auction house collects payment, it agrees to:
-
Collect the full instructed amount;
-
Remit funds within agreed timeframes;
-
Not deduct fees unless agreed in writing.
Lots2Go may charge reasonable fees for failed collections, additional administration, or storage resulting from auction house processes.
Pricing may be updated with reasonable notice.
7. Liability & Risk (Auction House)
The auction house retains responsibility and risk for item(s) while on its premises.
Lots2Go is not liable for:
-
Loss or damage before physical collection;
-
Loss arising from descriptions or condition issues;
-
Buyer disputes relating to the sale.
Risk transfers to Lots2Go only upon physical collection.
Lots2Go’s liability is limited to loss caused by failure to take reasonable care while item(s) are in its possession and is subject to the liability limits in the Customer Terms.
Lots2Go shall not be liable for delays or failures caused by force majeure, including but not limited to extreme weather, government restrictions, industrial action, pandemics, or courier failures.
Lots2Go is not liable for indirect or consequential losses, including loss of commission or goodwill.
8. Insurance (Auction House)
Lots2Go maintains insurance for its own operations only.
The auction house acknowledges that:

Item(s) are not insured by Lots2Go while on auction house premises;

Buyer transit insurance is arranged for the sole benefit of the buyer;
-
The auction house is not a named or implied beneficiary of any insurance policy.
The auction house remains responsible for its own insurance cover for item(s) prior to collection.
9. Restricted & Prohibited Items (Auction House)
The auction house must not release prohibited items.
Prohibited items include:
-
Illegal goods
-
Weapons or explosives
-
Hazardous materials
-
Liquids unless agreed in writing
-
Perishables or live animals
Restricted items must be declared in advance.
Lots2Go may refuse collection, cancel services, or apply additional charges where prohibited or undeclared items are identified.
10. Storage & Uncollected Items
Lots2Go does not provide long-term storage unless agreed.
Where items cannot be collected or processed due to auction house issues, Lots2Go may refuse collection or apply storage/handling fees.
Lots2Go is not liable for loss or damage to item(s) that remain under auction house control.
11. Cancellations (Auction House)
Cancellations must be made in writing.
Fees may apply:

After scheduling or attempted collection;
-
After collection where costs have been incurred.
If cancelled post-collection, Lots2Go may return item(s) or hold them subject to charges.
Lots2Go is not liable for buyer dissatisfaction due to auction-house-initiated cancellations.
12. Data Protection
Each party shall comply with UK GDPR.
The auction house confirms it has a lawful basis to share buyer data.
Lots2Go will process data solely to provide services and manage delivery, claims, or payments.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
All disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
